Blackmagic warrants each Blackmagic
Replacement cartridge is free from defects in materials and
workmanship at the time of shipment and installation, valid
for one year from date of purchase. This warranty does not
cover print count life or normal wear and tear. In addition,
this warranty does not cover failures resulting from misuse,
accident, modification, improper maintenance by you,
improper storage or installation, or unsuitable physical or
operating environment.
In the event your Blackmagic Replacement cartridge is found
to be defective during the warranty period, Blackmagic will
at its option, subject to reasonable verification of such
defect, [replace the cartridge with one that is at least
functionally equivalent or refund your money].
In the event that an Blackmagic Replacement cartridge, found
to be defective, causes damage to any compatible laser
printer for which it is designed for use during the warranty
period, Blackmagic will reimburse you for the actual cost of
repairs required to correct printer damage caused by the
Blackmagic Replacement cartridge. Reimbursement is
conditional on you providing Blackmagic 1) satisfactory
evidence that the cartridge was the actual cause of damage
during the warranty period, 2) A signed statement from the
company performing the repair, on company letterhead,
stating that the damage was caused by the cartridge, 3) The
original itemized invoice for the repairs performed, and 4)
A copy of the service report showing the name and address of
company performing the repairs.
THESE WARRANTIES ARE YOUR EXCLUSIVE WARRANTIES AND REPLACE
ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR
CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE.
IN NO EVENT SHALL Blackmagic OR ANY OF ITS SUBSIDIARIES BE
LIABLE FOR ANY SPECIAL, INCIDENTAL OR INDIRECT DAMAGES OR
FOR ANY ECONOMIC CONSEQUENTIAL DAMAGES (INCLUDING LOST
PROFITS, BUSINESS REVENUE, GOODWILL OR ANTICIPATED SAVINGS).
Cartridges are recovered and contain new and reprocessed
materials. Regardless, our warranty terms apply.
